Terms of Service
Effective 20 June 2026
1. Agreement
These Terms of Service (the “Terms”) form a binding agreement between you and Yves Boutellier, an individual sole proprietor based in Switzerland (“we”, “us”), governing your use of Chong — the web app at chong.today, the iOS app of the same name, and any related services (together, the “Service”). By creating an account or using the Service, you accept these Terms.
If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 if you live in the EEA or the UK) to use the Service. By using the Service you confirm that you meet this requirement and that any information you give us about yourself is accurate.
3. Your account
You sign in with Google or Apple. You are responsible for keeping the account credentials you use to sign in secure and for everything that happens under your account. Notify us promptly if you suspect unauthorised access.
You may close your account at any time from inside the app or by emailing us. See the Privacy Policy for what happens to your data afterwards.
4. Acceptable use
You agree not to:
- Use the Service to break any law, infringe anyone's rights, or harass anyone — including any witness you invite.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent local law explicitly permits.
- Probe, scan, or test the vulnerability of the Service without our prior written consent.
- Use the Service to send spam, malware, or other harmful content.
- Use automated systems (bots, scrapers) to access the Service in a way that interferes with its operation.
- Resell, sublicense, or commercially redistribute the Service.
5. Your content
You keep ownership of everything you write into the Service — journal entries, projects, tasks, reflections, and so on (“Your Content”). You grant us a worldwide, royalty-free, non-exclusive licence to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you. We do not claim any other rights to Your Content and we do not use it to train AI models.
You are responsible for what you write. Do not put content into the Service that you do not have the right to store there.
6. Witness feature
You can invite one person to act as an accountability witness for a specific project. By inviting a witness:
- You confirm you have permission to share the project's structure (title, momentum signal, trap patterns) with that person.
- You acknowledge that only the five specific data points listed in our Privacy Policy cross from your account to the witness's account. The witness cannot see task content, sub-tasks, schedules, notes, journal entries, or anything outside the witnessed project.
- You may revoke the witness link at any time from the project screen, after which the witness loses access immediately.
- The witness may also leave the role at any time.
The witness feature is provided as an accountability tool. We do not mediate disputes between you and someone you have invited as a witness.
7. AI coach — not professional advice
The Service includes AI-generated content (the clarity check during onboarding, suggested reframes inside the trap modal, and similar features). This AI content is for reflection only. It is not medical advice, mental-health treatment, psychological therapy, legal advice, financial advice, or professional coaching of any kind. If you are in crisis, contact a qualified professional or your local emergency services. Do not rely on the Service for any decision that has legal, financial, medical, or safety consequences.
AI output can be incorrect, biased, or inappropriate. Treat it as a prompt for your own thinking, not as a source of truth.
8. Plans, billing, and refunds
8.1 Paid access
Chong is a paid product. You can either buy founding access — a one-time payment that grants access for the lifetime of the Service — or take a recurring subscription (monthly or annual). New accounts do not include a free trial; reaching the app requires an active plan. Some accounts created under an earlier version of the Service received a free trial and continue under the terms shown to them at that time.
8.2 Founding (lifetime) access
Founding access is a single one-time payment. It does not auto-renew and is not a recurring charge. “Lifetime” means for as long as we operate Chong as an active service — it is not a guarantee that the Service will run forever. If we discontinue the Service, the “Changes to the Service” and liability sections below apply.
8.3 Subscriptions
Paid subscriptions auto-renew at the chosen interval (monthly or annual) until you cancel. The price you see at the point of purchase is the price you will be charged at renewal, unless we notify you in advance of a change.
8.4 Billing
On iOS, billing and renewal are handled by Apple in line with the App Store terms. You manage and cancel iOS subscriptions through your Apple ID Subscription settings. On the web, billing is handled by Stripe, and you can manage or cancel from your account page.
8.5 Refunds and money-back guarantee
Founding access includes a 7-day money-back guarantee: if it doesn't move you, email us within 7 days of your purchase and we'll refund it in full. Subscriptions renew automatically — cancel any time to stop future charges; EU and Swiss consumers may also exercise the statutory right of withdrawal within 14 days of purchase by emailing us (unless you have already actively used the paid Service in that period, in which case that withdrawal right may be waived). App Storepurchases are subject to Apple's refund policy.
9. Changes to the Service
The Service evolves. We may add, remove, or change features at any time. We will not remove a feature you are actively paying for without offering a reasonable equivalent or a prorated refund.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if your account is used in a way that risks the Service or other users, or if we are required to do so by law. Where possible we will give you notice and an opportunity to fix the issue first.
On termination, the licences you grant us continue only to the extent needed to remove or anonymise Your Content under the Privacy Policy.
11. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure against every threat, or that any AI-generated content is accurate or suitable for any purpose.
12. Limitation of liability
To the maximum extent permitted by law, our total cumulative liability for any claim arising out of or related to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) fifty Swiss francs (CHF 50).
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence).
13. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, your violation of any law, or your infringement of any third party's rights — including any harm caused to a person you invite as a witness.
14. Governing law and jurisdiction
These Terms are governed by the substantive laws of Switzerland, without regard to conflict-of-laws principles. The exclusive place of jurisdiction for any dispute arising out of or in connection with these Terms is Zurich, Switzerland — except that consumers domiciled in the EU or the EEA may also bring proceedings in the courts of their place of residence, as required by mandatory consumer-protection law.
15. Apple-specific terms (iOS)
If you obtained the iOS app via the Apple App Store, the following also applies:
- These Terms are between you and us, not Apple. Apple is not responsible for the iOS app or its content.
- Apple has no obligation to furnish maintenance or support for the iOS app.
- If the iOS app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the iOS app.
- We, not Apple, are responsible for addressing any product-liability claims, claims that the iOS app does not conform to legal or regulatory requirements, and claims arising under consumer-protection law.
- We, not Apple, are responsible for handling any third-party claim that the iOS app or your use of it infringes that third party's intellectual-property rights.
- Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the iOS app and may enforce them against you.
16. Changes to these Terms
We may update these Terms as the Service evolves. The “Effective” date at the top reflects the latest change. Material changes will be highlighted in-app or by email before they take effect. If you do not agree to the updated Terms, stop using the Service and close your account.
